Terms of Service & Legal Disclaimers

1. Acceptance of Terms

By downloading, installing, accessing, or using the BCAway iOS application, Android application, or web application (app.bcaway.app), you explicitly agree to be legally bound by these Terms of Service and Disclaimers. If you do not agree to every term set forth herein, you must immediately uninstall and cease all use of the application.

2. Non-Affiliation Declaration

You acknowledge and understand that:

• BCAway is entirely independent and is not an official school communication service.
• Bergen County Academies (BCA) and the Bergen County Technical School District (BCTS) do not maintain, operate, review, control, or endorse this software.
• Any trademarks, school names, period terminology ("IGS", "BCA"), or references are used purely descriptively under nominative fair use to describe publicly posted school schedules.

3. "As-Is" & "As-Available" Informational Disclaimer

BCAway is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise:

• No Guarantee of Accuracy: Absence data and bell schedules are parsed from publicly available or school-posted notice boards. Information may be delayed, incomplete, superseded, or contain inaccuracies.
• Unannounced Schedule Alterations: School schedules are subject to unannounced changes by school administration at any time (e.g., emergency drills, assemblies, weather delays, substitute teacher coverage, room reassignments).
• Non-Binding: No information in this app constitutes official confirmation of teacher absence or free period authorization.

4. Student Attendance Responsibility

Students remain 100% personally responsible for adhering to all official school attendance regulations and policies set by Bergen County Academies and the BCTS Board of Education.

• Students must confirm with a faculty member, proctor, or school administration before assuming they are permitted to leave a classroom or report to common areas (cafeteria, library, auditorium).
• Relying on information provided by BCAway does not excuse tardiness, cutting class, absence from assigned study halls, or failure to report to designated substitute locations.

5. Comprehensive Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL:

• Bergen County Technical Schools (BCTS), Bergen County Academies (BCA), or their trustees, officers, administrators, teachers, and employees;
• Kabir Sekhon (Developer); OR
• Savera Continental LTD. (Publisher), its officers, directors, agents, and affiliates;

BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

1. Academic disciplinary actions, detentions, suspensions, attendance infractions, loss of credit, or grade reductions;
2. Failure to receive, view, or parse accurate schedule or absence notices;
3. Device malfunctions, data loss, interruption of service, or push notification delivery delays;
4. Any loss, harm, or inconvenience arising out of or in connection with your access to or use of, or inability to access or use, BCAway.

6. Indemnification

You agree to defend, indemnify, and hold harmless Kabir Sekhon, Savera Continental LTD., Bergen County Academies, and Bergen County Technical Schools from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of BCAway, violation of school policies, or violation of these Terms.

7. Intellectual Property & License

The software, UI design, code, graphics, and branding of BCAway are licensed under the GNU Affero General Public License (AGPL) v3.0, unless otherwise noted. You may not misrepresent the origin of this software or use it to mislead users regarding school affiliation.

8. Governing Law & Severability

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without giving effect to any principles of conflicts of law. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
